The Town of Goderich manages the Maitland Cemetery, licenced as Cemetery Operator Licence No. OP-3277800. The Maitland Cemetery itself holds Licence No. CM-2001496.

Bereavement Authority of Ontario (BAO):

The Cemetery By-Law outlines our cemetery operations, including rules, entitlements, and restrictions. 

Fees:

As outlined in the Fees and Charges By-Law. Please note that additional fees apply to any interments taking place past 4 PM during the week, on Saturdays, Sundays, and Holidays. 


Arranging a Burial (Interment):

  1. Burial Permit or Certificate of Cremation
  2. Completed Interment Order 
  3. Payment

Information to Provide:

  •  Deceased Information:
    • Full Name
    • Date and Place of Birth
    • Date of Death
    • Last Known Address
  • Interment Details:
    • Date and Time of Interment (provide at least 48 hours' notice)
    • Plot Information (Lot, Section, and Range Number)
    • Usage of Vault 
    • Funeral Home and Director Name (private arrangements can be directly made with the cemetery staff)
  • Authorization:
    • Name of Interment Rights Holder(s)
    • Name of Requestor 
    • Relationship to Deceased 
    • Contact Information (Address, Phone Number, Email)
  • Next Steps:
    • The Deputy Clerk will arrange a meeting to sign your Interment Order and settle any remaining fees. 

When there are no living Interment Rights Holder(s), the following applies:

Sole Owner:

  • If the sole owner of the Interment Rights passes away, they can be buried in their plot, and any future interest in those rights becomes part of their estate.

Joint Owner:

  • For joint owners, the surviving Rights Holder(s) must give permission for any interment to take place. The Interment Rights automatically go to the remaining owner(s).

Power of Attorney:

  • A Power of Attorney becomes invalid upon the Interment Rights Holder's death; thus, the person holding it loses authority over the Interment Rights.

If the Interment Rights Holder left a Will:

  • The Executor must provide authorization.

If the Interment Rights Holder did not leave a Will:

  • If there is no Will, succession laws apply, and any new Interment Rights Holder(s) (minimum 18 years of age) will be established, at no charge, in the following order:
      • Spouse
      • Children - if no Children, then,
      • Grandchildren - if no Grandchildren, then,
      • Great-Grandchildren - if no Great-Grandchildren, then,
      • Parents - if no Parents, then,
      • Brothers and Sisters - if no Brothers or Sisters, then,
      • Grandparents, if no Grandparents, then,
      • Uncles, Aunts, Nieces, and Nephews.

Purchasing a Grave or Niche:

Contact the Cemetery Foreman:

  • Call 519-524-8344 Ext. 380.
  • Set up a meeting at the cemetery to select your preferred grave or niche.
  • After choosing, you will receive a slip with the plot details.

  • Provide the slip with your plot information.

Information Needed:

  • Indicate if the contract is for one individual owner (sole owner) or multiple individuals (joint owners)
  • Full Name(s) (including middle name)
  • Contact Information (Address, Phone Number, Email)
  • Plot Information (Lot, Section, and Range Number)

Next Steps:

  • The Deputy Clerk will arrange a meeting to sign your Interment Rights Contract and settle any remaining fees. 

Common Questions and Answers:

Ontario law requires that every Interment Right be sold in perpetuity. This means you and your heirs will own the Interment Rights forever.

Yes, you must provide written, signed documentation (preferably typed) in which the Interment Rights Holder pre-authorizes who can be buried in the future. Having this document in place avoids having to obtain permission or direction at the time of an interment.

Yes. We permit the transfer of interment rights. To transfer Interment Rights, the current holder (or their estate) must apply, provide their original Interment Rights Certificate, and complete the transfer documentation. You will then need to pay the transfer fees, after which you will be provided with a new Interment Rights Certificate to the transferor.
